The dog ate my homework

And the hard drives of every computer and server in the administration, the little scamp!

Steve Bates of The Yellow Doggerel Democrat notes:
A federal magistrate has ordered the White House to answer a simple question: does it, or does it not, have backups of White House emails between 2003 and 2005. The judge, John Facciola, ordered a lower court judge, Henry Kennedy, to issue a court order requiring an answer..
The White House's response to CREW's requests:

"CREW has yet to provide any basis for their assertions -- be it their original assertion, or their new claim. We are aware that some e-mails may not have been automatically archived in the past, but they may be available on backup tapes. Unlike what the liberal group CREW has asserted, we've never been without a backup system. The Office of Administration at the White House has been maintaining and preserving backup tapes for the official email system."

Has anyone checked those mysterious man-sized safes said to be in Dick Cheney's office?

Unfortunately, the lower court judge, Henry Kennedy, who was ordered by federal Judge John Facciola to probe the matter, refused to do so, saying (in the words of the
AP article), "there was no evidence the Bush administration violated a court order and the Justice Department deserved time to conduct its own investigation."

And rightly so... because of course one can always trust an Executive department to investigate possible Executive misdeeds.

Was the judge bought off? blackmailed? who knows. All I know is that justice was not served.

Dear god. We will have so much clean up to do when the Bush administration runs for the exits on January 20th. It's the judges that make the difference, as Pat Robertson so clearly indicated.

How hard are judges to get rid of? It would sure speed things up if we just passed a law saying any judge who supported the Bush administration in any of its illegal activities will be fired unless they can prove they were being blackmailed....
