It's going to be a damnably difficult case to make in court, considering the feral gummint in such cases makes up the rules of evidence as it goes along.
And if I don't miss my guess, ACLU was almost certainly denied access to 90 percent of the documentation and evidence it needed to make the case. All of those Baby Bush torture cases were run that way.
Don't be too surprised if 1) the ACLU loses the suit, and 2) the CIA retaliates by charging one or more ACLU lawyers with assorted crimes... seriously, it's happened before to other lawyers.
It is a genuinely brave act to confront the CIA on anything, and it is an area in which the Obama admin acts like a goddam dictator. The ACLU deserves our thanks.

Yes. I am truly grateful for the ACLU. Even though I know this may be tilting at windmills, I'm glad they are trying.
